Under the European Patent Convention (EPC), a European patent shall, in each of the contracting states for which it is granted, have the effect of and subjected to the same conditions as a national patent granted by that state, unless otherwise provided in the European Patent Convention.
The European patent application process is a two step process. The first step involves the filing of patent application (Regional Application or PCT National Phase Application), examination and grant procedures at the EPO. The application may be filed in one of the three official languages of the EPO: English, German or French. After the patent is granted, the patent claims must be translated into other two official languages, prior to publication of the granted application by the EPO.
The second step is the validation process, in which the applicant must fulfill the filing requirements in each contracting states within the three (03) months of the official grant date, provided by EPO.
