Dana Hentges Sheridan, General Counsel and Chief Compliance Officer at Active Captive Management, Named to 2014 “Power 50” by Captive Review

Dana Hentges Sheridan, General Counsel and Chief Compliance Officer of Active Captive Management (ACM), has been named to the prestigious 2014 Power 50 list by Captive Review. More than 600 nomination submissions were received, with each submission containing votes for three individuals. Captive Review ranked Dana #29 and cited her as among the top experts working in the “growing smaller captive space.” At Active Captive, Dana leverages some 20 years of experience in insurance, regulatory compliance, and risk management. Prior to joining Active Captive, Dana practiced in a law firm setting as a trial attorney and insurance coverage counsel, where she represented commercial insurance companies.

Active Captive Executive Staff Attends the 2014 Hawaii Captive Insurance Council Conference.

Cinda Carbone, EVP of Sales attended the Hawaii Educational Forum 2014 which provided an excellent agenda for the 220 attendees with more than 30% of the participants captive owners. Stephen Schott , the keynote speaker and captive owner, provided a rare insight into his ten year co-ownership of the Oakland Athletics and the “real story” behind the Money ball A’s.
 
Sanford Saito, the Deputy Commissioner and Captive Insurance Administrator provided excerpts from a recent interview with BestReview.com:
 
“Hawaii is home to 188 active formations.”
 
“Our captive regulatory unit is a specialized branch within the Insurance Division that focuses specifically on the needs of captives and captive regulations. We’ve had continuing and steady support from the governor and legislators to ensure that we are properly staffed to serve captive owners and to keep the laws and regulations up to date in this rapidly changing area. Since last summer we’ve added five new captive positions to bring our total number on staff to 15 professionals in the Captive Branch…”
 
Hawaii offers certain premium tax advantages to captive insurers. “The highest premium tax rate is 0.25% on premiums up to $25 million, and it’s a decreasing sliding scale thereafter. Our maximum premium tax is $200,000 and we have no minimum tax. We do not tax assumed reinsurance premiums or captive premiums that are already taxed elsewhere and that is particularly beneficial for large fronted programs or captive risk retention groups.”

The October 2014 edition of Captive Review features an article on the NAIC's proposed definition of "multi-state reinsurer" - a topic many in the captive industry are following with interest.  It looks like the industry can breathe a sigh of relief as it appears the NAIC's F Committee will be revising the problematic definition in response to industry outcry that it was over-broadly worded.
