If you have been to prison and would like to petition the superior court for a Certificate of Rehabilitation you should consult a criminal defense lawyer to assist you in the process.  A criminal lawyer can help you prepare a good looking petition that focuses on the points that are important to the D.A. and the judge. You may be surprised to learn that the lawyer may prioritize certain relevant evidence differently than you do.  So, if you are looking to have the Certificate of Rehabilitation kick start your application for a  Gubernatorial Pardon application in the hopes of restoring your firearms rights, or to seek relief from certain sex offender registration requirements (under Penal Code section 290), or to increase your chances of getting licensed by the State of California, call us to talk about how we can help you with your petition for a Certificate of Rehabilitation.

Proposition 47 was passed by California voters this past November. This new law helps people with certain felony convictions get them reduced to misdemeanors.  Individuals who suffered convictions for amongst other things, (1) commercial burglary, (2) grand theft, (3) check fraud, (4) petty theft with priors, (5) receipt of stolen property, and (6) possession of cocaine, metamphetamine, MDMA, concentrated cannabis (and certain other drugs), have three years (unless good cause for longer delay is shown) from the passage of Proposition 47 to petition the court of conviction to reduce their felony conviction to a misdemeanor.  If you have been convicted of a felony within the past 3 years give us a call to talk about whether you are eligible for relief under Proposition 47, Penal Code section 17(b) or section 1203.4 - i.e., the good stuff to get your case reduced to a misdemeanor or a conviction set aside for employment purposes.
