Oklahoma’s Remarriage Waiting Period: After a divorce, people often move on to a new partner quickly. In fact, most people remarry within five years of their first divorce. In Oklahoma, however, settling down quickly with a new love interest may cause legal problems for you and your new partner. Here’s what you need to consider:


Under state law, it is illegal to remarry in an Oklahoma court within six months of an Oklahoma divorce decree. The only exception is if the previous spouse is deceased or the parties are remarrying their former spouses. If someone wants to marry a new spouse within six months of an Oklahoma divorce, he or she must leave the state to do so. Violating this law could result in a felony charge of bigamy, which is punishable by up to three years in prison.


Under Oklahoma law, it is illegal to cohabitate with a new partner with six months of an Oklahoma divorce. Even if the parties leave the state to remarry, they cannot legally cohabitate within Oklahoma. Violating this law could result in a felony charge of adultery, which is punishable by up to five years in prison and a $500 fine. Further, both cohabitating parties are subject to prosecution under the adultery statute.

In 2011, Craig Summers underwent spinal surgery. The operation was to be carried out on the right side of his spine. Following the operation, Summers allegedly experienced excruciating pain on the left of his spine and claims that he underwent wrong side surgery despite his confirmation of procedure to his surgical team prior to the operation. The case is complicated as his surgeon insists he operated on the correct part of Summer’s spine but made an incision on the left since he is right handed.

While the outcome of the case has yet to be decided, it nonetheless highlights the importance of good communication between patients and their doctors and amongst the medical team.

Patients who possess full mental capacity and are over the age of 18 are required to provide their informed consent for surgical procedures. Usually, prior to signing a consent form, the process to be carried out is described in detail to the patient. Checking with the patient is just one risk management process that should be carried out by the medical team before surgery or other procedures are commenced.
