Even when estate plans are prepared properly and beneficiaries are correctly designated, the need for medical directives, HIPAA releases and powers of attorney are still relevant to make sure the family has all the access they need. In the case of Joan Rivers, because her daughter was not appointed Power of Attorney, Rivers’ estate must now undergo probate court in order for Melissa to retrieve the medical records she seeks. So often after the passing of public figures like Robin Williams and Philip Seymour Hoffman, the details of their estate are released, revealing some serious estate planning difficulties. Hoffman, for example, intended to leave his partner a lasting legacy, but unintentionally left her with a huge tax bill instead.
