The Supreme Court will undertake a major examination of privacy in the digital age, holding oral arguments Tuesday on a pair of appeals over whether police must obtain a warrant to search data on the cell phone of a person under arrest.
New precedents will be set not only for criminal cases, but also in determining cause in #autocollisions.  Right now, texting while driving is difficult to prove, and still will be to some degree even with access to phone records, but certainly clarity is needed as to whether or not this access will be available to law enforcement at the accident scene.

Criminal suspects in Massachusetts and California were convicted, in part, after phone numbers, text messages, photos and addresses obtained from personal electronic devices linked them to criminal drug and gang activity.

Fibromyalgia and Social Security Disability Benefits

Many clients with Fibromyalgia have described their pain to me as a flu like muscle ache that is worsened by activity, stress and sometimes even being touched. Fibromyalgia is usually diagnosed by tender points on a person’s body. There is a base level of pain which can be exacerbated when clients have a flare. A flare can last for a day or a month (or longer).

Doctors usually recommend stress reduction, exercise, relaxation or medication as ways to alleviate your Fibromyalgia pain. If you have followed your doctor’s advice regarding your Fibromyalgia but your symptoms still keep you from working, you may need to consider filing a claim for Social Security Disability.

Believe it or not, there are some doctors who still do not believe that Fibromyalgia exists despite all evidence to the contrary. Fortunately, the Social Security Administration has recognized that Fibromyalgia can be a severe impairment (See SSA Ruling 12-2p for discussion of SSA’s evaluation of Fibromyalgia). While there is no listing for Fibromyalgia, the affect that Fibromyalgia has on your ability to work must be considered by the Social Security Administration.
