Both of my last two clients with marijuana DUI charges in Jefferson County had their charges reduced to a plea to reckless driving. In both instances, their active THC / blood test results were greater than 5 nanograms. However, in both cases the evidence related to impairment was questionable, and in both cases we had district attorneys that were reasonable.

In Colorado, Harassment could be thought of as Assault without the injury. Several different types of acts can be charged as Harassment, however, the most common basis for a Harassment charge is the allegation that the accused "striked, shoved, or kicked" the alleged victim. If the same facts caused injury, then it would be charged as Assault. The injury that is required to elevate Harassment to Assault can be mere pain.
