The 5th Circuit Court of Appeals holds that after a rescission of acceleration, mortgage lenders in Texas must re-notice intent to accelerate before they can conduct the valid foreclosure of a borrower's home. This is a good decision for Texas consumers that are delinquent on their home loans. It makes mortgage companies give their borrowers another notice prior to accelerating or calling their entire loan due, if they had previously rescinded or cancelled acceleration of the same loan. If your home is posted for foreclosure in Texas by your mortgage company, don't just let the foreclosure take place, unless you re ready to give it up. You may have other options such as filing chapter 13, and catching up the delinquent payments over a 3 to 5 year period.

Court-appointed receivers have a lot of power to collect judgments in Texas. If they seize money, bankruptcy is one option for dealing with the underlying judgment itself and also possibly recovering the money in the right circumstances.

We are referred cases from time to time by other bankruptcy lawyers. Sometimes we accept bankruptcy cases in our Houston, Texas​ law office that other lawyers do not want, either because they are more difficult cases than they want, or the cases involve unusual facts that the other lawyer or lawyers do not want to have to deal with.

Our main job as lawyers in our Houston, Texas​ law office is to save people's homes from foreclosure and give them a chance to catch up the payments. We did that for these Tomball, Texas clients by filing a chapter 13 bankruptcy for them and stopping their foreclosure. But they had an underlying dispute with the holder of their seller-financed mortgage so we had to get the bankruptcy court involved by objecting to the proof of claim that was filed. It worked out rather well in this case, the clients are very pleased. They will be able to keep their house and pay it off in full through a five year plan that they can afford.

I told a client and his wife about this recently at my Houston, Texas​ law office and they were totally shocked. "Not paying over I.R.S. payroll taxes is a crime?" Yes, and the large amounts that they owe could lead to a stiff prison sentence. I think they will take this more seriously from now on; this is not like being in default on a credit card debt or a bank loan. This is literally stealing money from the U.S.A.

Houston divorcee relieved of $38,500 in I.R.S. taxes on innocent spouse claim. We love to help people deal with their I.R.S. tax problems, either in or out of bankruptcy. If the primary financial problem is the Internal Revenue Service, we will help the client resolve their tax problems at the least cost possible, either by helping them settle the debt, a payment plan, or as in this case and when the facts are right, by having one spouse relieved of the joint tax liability.

I guess title loan companies make a lot of money, because they sure charge very high fees! This title loan company's claim was slashed by the Houston, Texas​ bankruptcy court from $5592 to $1794; our client was very happy, because now that is all she has to pay (plus about 5% interest) through her chapter 13 plan to get her title back.

We try to be friendly and yet at the same time professional, as this recent chapter 7 bankruptcy client tells us. We also try to have a relaxed office experience at our west Houston, Texas​ law office, because debt problems can cause people a lot of stress. And while we can't promise that everything will be perfect as it was for these clients, we will do the best job that we can do for all of our clients.
