Redmans undertook an employment tribunal case on a no win no fee contract for Mr Hatton. Mr Hatton’s responsibilities under this contract included a responsibility to not deliberately mislead us and, further, to provide all relevant documentation in his case.

Mr Hatton provided a number of documents to Redmans and was asked to disclose any further documents which could affect his case (whether positively or adversely). On the basis of the documents disclosed by Mr Hatton, his claim appeared to have reasonable prospects of success.

When disclosure was received from the other side it was found that a substantial number of relevant documents that adversely affected Mr Hatton’s case, and which he should have had possession of, were not provided by Mr Hatton to Redmans. The receipt of these further documents led Redmans to conclude that Mr Hatton’s case no longer had prospects of success and that, further, Mr Hatton had deliberately failed to disclose the missing documents. Redmans' contract with Mr Hatton was therefore terminated.
