What is a Contested Divorce?

When the two parties to the marriage do not agree to divorce, or do not agree to the “terms” of divorce, then the divorce becomes “contested.” Maryland Courts label divorce cases “contested” when not all issues in the case have been resolved. It means that the case is in the process of going to a trial before a Judge where some if not all unresolved issues will be determined after evidence is taken by a Judgment of the Court.

"Divorce 101" is a 6-week series of public education seminars to help people contemplating or in the early stages of divorce. The program runs Tuesdays, Mar 3 to Apr 7, 7-9 PM, at the Montgomery County Bar Foundation in Rockville (27 West Jefferson St); the cost is $10/session or $50 for all 6, payable at the door. Each session will be conducted by prominent attorneys, counselors and financial advisors on topics like Basic Law, Approaches to Divorce, Financial Considerations and Finding Support. At the Law Office of Kendall Summers we help clients in all aspects of separation and divorce. For most cases this involves the preparation of a Voluntary Separation and Property Settlement Agreement. When families are going through a divorce process, there are many are many areas involving the children, their finances and their property that need to be resolved. One option to work through these issues is the judicial or court process, which involves initiating a divorce case and proceeding with the case until if settlement does not occur, a trial is heard and the remaining issues are resolved by a court order issued by a Judge. Whether spouses initiate settlement discussion from the beginning or pursue the judicial path seeking a court order, continuous opportunities are present for negotiation and settlement. When settlements discussions are successful, they result in a Voluntary Separation and Property Settlement Agreement, which covers all or some of the issues that need to be resolved between the parties.
