Stay Current on Meaningful Use Penalties

Starting in 2015, all eligible providers who have not attested to meaningful use of their EHRs for 2014 will encounter a 1% penalty on their Medicare reimbursement. Penalties will continue to increase to 2% in 2016 and 3% in 2017. Eligible providers currently enrolled in the program must attest for 2014 by Feb. 28, 2015, to avoid the 2015 penalty.

Due to late arrivals of needed software and lengthy installation, the Centers for Medicare & Medicaid Services has extended the deadline for eligible hospitals and critical access hospitals to attest for meaningful use for the 2014 reporting year from November 30 to December 31.  Hospitals that fail to meet their meaningful-use requirement in 2014 will have those Medicare payment adjustments applied beginning October 1, 2015. 

In the meantime, providers can use 2011 and/or 2014 edition certified EHR technology. They can attest this year to either Stage 1 or 2 meaningful use measures and report either 2013 or 2014 clinical quality measures. As of now, almost 4,700 hospitals have been paid approximately $15.2 billion under the program.

The Office of the Inspector General has requested a $400 million FY budget and an additional 284 full-time employees to help expand their audits of the healthcare industry’s use of electronic health records, HIPAA security, EHR incentive payments and fraud.

Priorities for 2015 include: 
• Identify EHR system fraud and determine "how certified EHR systems address these vulnerabilities."
• Review Medicaid and Medicare EHR incentive payments and ascertain if providers or hospitals received payments they should not have received.
• Analyze the IT security of community health centers funded by the Health Resources and Services Administration.  
• Review the Centers for Medicare & Medicaid Services health information technology systems and verify the agency adopted necessary security controls to protect EHR data. 

"We will perform audits of various covered entities receiving EHR incentive payments from CMS and their business associates, such as EHR cloud service providers, to determine whether they adequately protect electronic health information created or maintained by certified EHR technology," OIG officials outlined in the 2015 report.
