There seriously may be a case, based on the Hobby Lobby decision and the Religious Freedom Restoration Act, for someone who files bankruptcy and cannot include his student loans. If that person's sincere religious beliefs are such that he can't pay on loans for religious reasons, say because it enslaves him to money, then applying the bankruptcy protection to him is substantially burdensome.
There are of course problems with this; but it eats at the RFRA. A case similar to this rationale (preferably one though where the government is asking for the money directly, instead of indirectly through federally backed loans) may cause RFRA's repeal.
Our oligarchs wouldn't want to lose out on their student loan windfall. #RFRA #repeal #HobbyLobby
