Consumer Warning: Cellphone radiation study raises concerns despite low risk http://ow.ly/oTVs300FCga A new federal cellphone study in rats, finding a slight increase in brain tumors only males, is raising long-dormant safety concerns. The study is part of a seven-year, $25 million effort conducted by the National Toxicology Program at the request of the Food and Drug Administration. It looked at the specific type of radiation that cellphones transmit, called non-ionizing radiofrequency.
WASHINGTON (AP) — National Institutes of Health expert reviewers are finding flaws in the agency's new study that connects heavy cell phone radiation to a slight increase in brain tumors in male rats.

Harvard researchers unveil new Alzheimer's theory http://snip.ly/0bnul The researchers think that the immune system may play a key role in the development of Alzheimer’s, which slowly robs people of their memory and is eventually fatal. A protein called beta amyloid, long considered the bad actor in Alzheimer’s, actually plays a positive role in fighting off bacteria and fungus in mice, worms and cells, the researchers showed in a new paper in Science Translational Medicine. Assuming that’s also true, it suggests that getting rid of amyloid, as some drug trials have tried, could be dangerous, and approaches that stimulate the immune system could be safer and more effective.
Researchers at Harvard this week offered a new theory of Alzheimer’s Disease that - if true - would upend our understanding of the disease and suggest new routes for treatment and prevention.

Good Decision?? - Google cleared of infringement in Oracle lawsuit over Java http://ow.ly/MytZ300Eism The jury found Google's use of Java was 'fair use'. The jury of eight women and two men took three days of deliberation to reach its verdict. Oracle was seeking up to $9 billion in damages, making it a huge victory for Google and its legal team. At issue was Google’s decision to copy 37 Java application programming interfaces, including thousands of lines of "declaring" code, into its Android operating system. Since the trial began on May 10, the jury has heard evidence from a parade of Silicon Valley bigwigs including Google's Eric Schmidt and Larry Page, Oracle CEO Safra Catz, and former Sun Microsystems CEO Jonathan Schwartz. Google's message to the jury was that Sun intended Java to be free for anyone to use, which is why it made the Java language open source in the first place. It cited a blog post from Schwartz, congratulating Google on Android's release, as evidence that Sun had no problem with Google's use of Java. #GoogleLawsuit

It's great news. But it doesn't remove the damage done to the software industry by the original appeal court decision. Deciding that Google's use of the APIs was fair use is good. Deciding that APIs should be protected by copyright the first place was disastrous and, despite this ruling, is going to have terrible long term consequences.

70,000 People Have Missed American Airlines Flights Due to Long Lines at Airport So Far This Year http://ow.ly/n6bf300C3u8 40,000 bags got left behind as well. A shortage of staff and a surge in air travelers have created a nightmare scenario for the U.S. Transportation Security Administration (TSA), with airport wait times in places like Chicago stretching beyond two hours. While TSA is taking steps to shorten lines such as hiring more full-time officers, it lacks the staffing to handle peak travel times this summer, Administrator Peter Neffenger said on Wednesday. #TSAissues

Could This Be A Future Class Action? Wall Street Journal Article: The Airline Fee to Sit With Your Family http://ow.ly/qQoX300Al3f U.S. and international airlines make fewer free, reserved seats available; only elites see some openings. Airlines have expanded extra-legroom seating on planes and labeled more plain coach seats as preferred, leaving fewer seats to reserve in advance without fees. Extra legroom seats on Delta are up to 16% of the coach cabin from 12% because of strong passenger demand, and another 16% of seats on average are preferred. With United, extra-legroom seats are now more than 25% of the coach cabin. Parents face the choice of adding fees on top of fares or begging other travelers on packed flights to switch seats so children aren’t sitting alone with strangers. Often when there are seats available that don’t require fees, they are all middle seats that would space family members one behind the other rather than side-by-side.
Scott McCartney explains why U.S. and international airlines make fewer free, reserved seats available and only elites see some openings.

Porter Ranch Gas Leak Situation: SoCalGas Ordered to Stop Cleanup of Porter Ranch Homes http://ow.ly/seNg300zNz3 Public Health officials assigned environmental health specialists to observe the cleaning performed by SoCalGas contractors over the weekend and determined the cleaning did "not comply with the cleaning protocol," according to a statement issued by the agency. "Public health found that the contractor was neither equipped nor trained for proper cleaning as required by Public Health,'' the agency said.
The Los Angeles County Department of Public Health has ordered the Southern California Gas Co. to halt its cleanup of Porter Ranch-area homes following a months-long gas leak.

Eight ‘is not a good number’ for the Supreme Court, Ginsburg says http://ow.ly/9x13300Eq0N The Supreme Court has deadlocked 4 to 4 in several cases since Justice Antonin Scalia’s death in February. Ginsburg told judges at a conference in New York that the situation is unfortunate because it essentially means important issues are being denied Supreme Court review, according to a copy of her prepared remarks. “That means no opinions and no precedential value; an equal division is essentially the same as a denial of review,” Ginsburg said.
Her colleagues have minimized the problem of not yet replacing Antonin Scalia.

Boeing 777-300 Safety Issues?? - Korean Air Jet Has Engine Fire in Tokyo, People Evacuated http://snip.ly/38x29 The Tokyo Fire Department said 19 people were either injured in the evacuation or felt unwell after it, Japan's Kyodo News service reported. Japanese television broadcast live images of fire trucks blanketing the left-side engine and almost the entire side of the plane with white foam as smoke came out of the back of the engine. Flight 2708 was headed to Seoul. The runway the plane was using was closed and all other flights were temporarily halted, Okada said. He said the cause of the fire was still unknown. #Boeing777

Engine fire? If that's the case, then I'd be looking at P&W (which was the engine supplier for this incident)

Future Class Action Against TSA????? TSA takes steps to combat long airport lines, but summer waits are forecast http://ow.ly/CKkz300Cu7e "Obviously waiting three hours for a two-hour flight is not acceptable and it's not a good thing and it taxes everyone's patience," he said. But he added, "We're not going to compromise aviation security because of this." Johnson's 10-point plan includes hiring more TSA officers, paying more overtime, deploying more canine teams and using airline workers to handle non-security functions at the checkpoints, such as moving bins. Congress agreed Wednesday to allow TSA to shift $34 million between its accounts to expedite the hiring of 768 new officers by June 15 and pay overtime for its 42,500 officers. "We want to keep people moving, but we want to keep passengers safe," he said. "There will be wait times as they move through aviation security checkpoints." #TSAconcerns
TSA officials announced steps Friday to reduce long lines at airport checkpoints, but warned that wait times will grow this summer.

Agree Or Disagree????? Patriots Argue Against NFL In Amicus Filing With Second Circuit To Support Tom Brady http://ow.ly/vfkZ300B0Dv The team filed an amicus curiae brief with the Second Circuit on Wednesday, arguing that commissioner Roger Goodell did not follow the rules laid out by the CBA during the disciplinary process of Tom Brady. “Unfairness has permeated the entire handling of this matter by the League,” it said. “Among other matters, and as set forth in Appellees’ Petition for Rehearing, the Commissioner treated Mr. Brady’s appeal not as an appeal but as a continuation of the investigation.”
The New England Patriots have taken their strongest stance yet against the National Football League in the never-ending DeflateGate saga.

New York Times Article: Climate Change Activists Either Prod Exxon Mobil or Sell It http://ow.ly/IknX300Akof One group is made up of investors who want to hold on to their stakes in the company and prod the oil and gas giant, through shareholder resolutions and by applying steady pressure, to adopt new policies that reflect the realities of climate change. The other major group is campaigning to make Exxon Mobil a pariah and is urging big institutional shareholders to dump all their fossil-fuel stocks. Both groups showed up in force on Wednesday at Exxon’s annual shareholder meeting here. Outside, several dozen protesters waved signs reading “ARREST EXXON” and “KEEP IT IN THE GROUND,” and chanted slogans like “Exxon lies, oceans rise!” and “Windmills, not toxic spills!”
Whether to negotiate new policies reflecting climate change or adopt a scorched-earth strategy has divided groups seeking change within the energy company.

Federal Preemption Narrowed for Aviation Product Manufacturers in Sikkelee v Precision Decision http://ow.ly/yQuj300oqLj The Jill Sikkelee v. Precision Airmotive decision negated a long legislative history that allowed federal law, such as the Federal Aviation Act and the FAA regulations, to override individual state tort laws in the field of aviation. If not overturned on appeal, the Sikkelee decision could require aviation suppliers to defend claims against conflicting tort laws of individual states. In Sikkelee, the plaintiff alleges that “faulty design of the lock tab washers as well as gasket set” on a 1969 Lycoming engine led to the crash of a Cessna 172N in 2005. During a 2004 overhaul, an MA-4SPA carburetor was installed per Lycoming’s type-certified design. The suit alleges that screws holding the carburetor’s throttle body to its float bowl vibrated loose, allowing fuel to leak into the engine and causing the crash.
