Remember, in criminal law, the burden of proof (to prove the offense you are charged with) is on the Crown and they have a duty to prove to the Court beyond a reasonable doubt that you have committed the crime in question. You may have in fact committed the crime but if the Crown cannot prove beyond a reasonable doubt that you in fact committed the crime, the law makes it is such that you must be found “not guilty”. The reason for that is that the legislation makes it preferable to allow a guilty person to be acquitted than to have a wrongful conviction and so the rights of the accused are held at a higher level to afford the accused this protection.
