The Full Federal Court of Australia has reversed the decision of the Federal Circuit Court in Lee & Ors [2014] FCCA 2881. This decision by the FCA now opens the way for those 457 visa applicants whose applications for review were found to be invalid on this jurisdictional ground to continue with those reviews.

The Government has announced important changes to the Significant Investor Visa and creation of a Premium Investor visa.
The new Premium Investor Visa (PIV) will require an investment of $15 million, nomination by Austrade and has no residency requirements. PIV holders will be eligible for permanent residency after holding the complying investment for 12 months.
Other changes include:
 the involvement of Austrade in the nomination of applicants on behalf of the Australian Government and in determining complying investment policy
 allowing 'role swapping' between primary and secondary applicants during the provisional visa stage
 introduction of 180 day residency requirements for secondary visa holders
 changes to improve visa processing times

Family Visas are now back (for a short time only!) The regulatory change to remove the family visas back in June has been disallowed by the the Australian Senate. This means that for a short time, valid visa applications can be lodged onshore for
- parent (non contributory)
- carer and
- remaining relative
visas! But do act quick because the visas will be removed again by the Government (we are informed this will be in March 2015)

We don't know why it has taken so long, but Immigration SA has finally made it easier for citizens and current passport holders of exempt countries to apply for South Australian state nomination.

Exempt Countries include:
United Kingdom
Canada
New Zealand
United States of America
Republic of Ireland

If you are a citizen or passport holder of one of the listed exempt countries, you no longer need to provide an English test result (IELTS or OET) to Immigration SA regardless of Immigration SA’s English requirement for your occupation.

Immigration South Australia introduced a new nomination pathway, 'chain migration', which allows applicants with an immediate family member permanently residing in South Australia to apply for a state nominated visa.

Chain migration enables applicants to access occupations on the South Australian Graduate List and occupations listed as special conditions apply.

Requirements

To qualify for the chain migration pathway, applicants must:

• Have completed a Bachelor degree or higher
• Meet all DIBP criteria and Immigration South Australia criteria
• Have 60 points on the DIBP points test.

To qualify for the chain migration pathway, the family member in South Australia must:

• Be the applicant’s grandfather, grandmother, father, mother, brother or sister. Applicants can still apply if it’s a step or adoptive parent/sibling.
• Be an Australian Permanent Resident or an Australian Citizen
• Have resided in South Australia for the past twelve months.

Immigration SA has updated their State Nominated Occupation List (SNOL) and related policies as at 1 July 2014.
These include:
 Adding further occupations to their SNOL
 Simplifying the state nomination process, including receiving an invitation within 2 business days if you are selected for state nomination.
 State nomination places will now be calculated on time of submission rather than time of decisions, so applications will not be refused due to planning levels being exhausted.
 Recognising applicants commitment to SA:
• Those who have worked in that state for at least 12 months in a skilled occupation, will have access to a more extensive occupation list,
• Graduates of SA universities access to the SA Graduate List of occupations,
• Graduates of SA VET courses access to occupations with 'special conditions' on the State Occupation List.
 Reductions in IELTS scores to 6 in each band to align with DIBP requirements, except for Health and Education Professionals who remain at 7 in each band.
 Allowing international graduates of SA graduates access to a work experience waiver if they are currently working 20 hours per week in SA their nominated or closely related occupation.
 Skills assessment validity requirements have also been changed to align with the recent DIBP changes.
