In all fairness and to be consistent, shouldn’t the Pentagon restore a forth star to General Kevin P. Byrnes, another officer retired in the lower three star rank for a far less egregious relationship with a woman while he was legally separated and divorcing his wife than GEN Petraeus had with Paula Broadwell.  GEN Petraeus acknowledged having an affair with Broadwell, and providing her classified material, all while still on active duty. 
 
Although rarely taken to Court Martial, violation of Article 134, Adultery, normally results in some punishment which is what happened to General Byrnes, a highly decorated Army 4-Star General that had a relationship that some might loosely describe as an “extramarital affair.”  At the time General Byrnes was the Army Training and Doctrine Command Commanding General and had been separated from his wife for over a year.  He was in the process of finalizing a divorce and the lady, who he later married, was an unmarried civilian with no connection to either the military or the government and he had made no attempt to hide the relationship.  On 8 Aug 2005, he was relieved of his command (coincidentally his divorce was finalized that same day), demoted to 3-Star Lieutenant General and unceremoniously retired from the Army.
 
The General was a popular and highly regarded leader credited with ushering in systemic changes in Army doctrine and training.  A decorated Vietnam War veteran, he had commanded the 1st Cavalry Division and the multinational troops in Bosnia, and had been the Director of the Army Staff.   He was set to retire that November after 36 years of unblemished service beginning when he was 19 years old and his “reward” was a reduction in rank to Lieutenant General or 3-Star rank.
 
In light of GEN Petraeus being allowed to retain his 4th Star, doesn’t fairness require that a fourth star be returned to GEN Byrnes.  For a full treatment on this subject, see my Blog article at: http://old-soldier-colonel.blogspot.com/
