A credit notation by a lender in a credit report that a debt is "charged off" is not a legal determination that the debt is not owed. To the contrary, it is an indication by the lender that the debt is more than one hundred eighty days past the point when it last received payment. The debt is now considered a loss as a receivable and therefore no longer an asset of the lender. From this point in time it may be either sent to a collection agency who will receive a commission or percentage of the money collected on the debt or the lender may also sell the debt to a third party for a certain percentage.

Just the other day a client arrived in my office who had employed a so-called debt negotiator. He had paid them $300/mo. for 11 months. Most of the payments went to pay their fees. A minor debt was settled. He was being sued and they admitted they could do nothing about. He easily qualified for a chapter 7 bankruptcy. Problem solved. No lawsuit. No debt. No hassles.

A successful chapter 13 case requires an experienced and knowledgeable attorney. Familiarity with the Chapter13 Trustee policies and practices and the local rules is critical. Despite the adversarial nature of our judicial system much deference is given the chapter 13 Trustee by the Judge to whom the Trustee is assigned.
