Divorce - Getting It Right The First Time

The recent judgment of Hermens v Hermens (December 2017) outlines the importance of ensuring applications for divorce are accurately and truthfully completed. Failing to do so may result in the application being dismissed in its entirety or applications being returned for correction. This ultimately leads to delays in processing your application.

The judgment reinforced that:

‘A divorce petition is a document which has the effect of changing the status of individuals permanently if it leads in due course to a decree of divorce and it is, as a matter of public policy, essential that the particulars in that document are true. That is why the Court requires the filing of affidavits attesting to the truth of what is in the petition.’

This week, Facebook’s CEO Mark Zuckerberg was questioned for two days by Congress due to the Cambridge Analytica scandal, in which the consulting firm was able to harvest data from 87 million profiles largely without consent during the 2016 US presidential election. As a result, the social media platform’s adherence to data protection laws is currently being considered problematic by many critics, with Zuckerberg apologising for the mistakes with regards to the privacy breaches.

Now, with the EU General Data Protection Regulation, more commonly known as GDPR, set to come into force from 25 May 2018, Euronews questions whether this regulation could have prevented the scandal from taking place at all. This is because, under the GDPR, companies like Facebook must have user’s express consent before they can receive and share personal data, or override their privacy preferences.

According to the Equalities and Human Rights Commission, 1,557 firms had missed the deadline to reveal their gap between the average hourly rate paid to male and female employees earlier this week.

All companies, charities and public sector bodies with over 250 employees had to submit their gender pay figures before this Wednesday's deadline.
