Dual Agency vs Designated Agency in Real Estate
In real estate sales there are some things that don't make a lot of sense from the consumers perspective.

One such situation is dual agency. In many states dual agency is described as one agent representing both the buyer and seller in the same transaction.

In California and a few other places they call dual agency two agents from the same company each representing a buyer and a seller.

In most places this is called designated agency. Are you confused yet?

If you are, you're not alone. Clearly, lots of real estate agents are also confused.

In fact, many agents have no idea that when dual agency exists you are NOT allowed to counsel a buyer or seller. You become a neutral party not exclusively representing either.

Frankly this arrangement sucks for buyers and sellers. If a buyer asks what they should offer on a home by law the agent is not allowed to guide them.

Many agents, however, love dual agency and with good reason - they get paid double.
