Convicting the Innocent

David Thorne was accused and wrongfully convicted of complicity to aggravated murder based on the coerced testimony of Joseph Wilkes. There was never any evidence linking David to involvement in the crime. The only thing that convicted him was the testimony of a casual acquaintance, Joe Wilkes. Joe's testimony was 'endorsed' by a high school friend and the friend's girlfriend, saying Joe told them, after casually bumping into them at a mall, that he was about to commit the crime. Despite the fact that the couple's stories differed on many vital details, that they both had arrest records, and that one of them was present to testify in court in his prison jumpsuit, the jury believed the charges against David and convicted him, giving him a sentence of life without parole.
Fourteen years later, we are still fighting for justice. The attorneys don't care, the judges don't care. They just cannot fathom that Joe Wilkes would confess to a crime he didn't commit, even though statistics prove that people often do just that. When you're 18-years-old and mentally and behaviorally challenged and detectives are screaming at you about your upcoming fate in the electric chair, you just might believe them. You just might say what they tell you to say. And Joe did.
It didn't matter to the jury that he had no clue how the crime even occurred. Or that he got every detail of the crime wrong.
The evidence presented at David's trial had nothing to do with David. It was about Joe. Prosecutor's threw down phone records and bank statements saying David called and paid Joe. Upon examination, none of the records reflect that. Still the jury didn't seem to mind.
David's attorney didn't even seem to mind, or he might have called witnesses to support David's innocence. But he didn't. In fact, he sat in his chair and tried to keep people from noticing how intoxicated he was. When the jury left the courtroom to begin deliberations, the attorney whispered 'guilty' to anyone close enough to hear.
In a post-conviction hearing, forensics expert Brent Turvey, Ph.D. testified that the crime Joe Wilkes confessed to did not even occur. Joe testified that the victim was fatally injured in a completely different room than she was actually attacked in. Shoeprints left at the scene and attributed to Joe were three sizes smaller than the shoes he wears.
We are still trying to convince the world that David is innocent. But, according to every court in the state, since no one ever accused David of being at the scene, DNA evidence isn't relevant. Since the police, the victim's family and random civilians trampled the crime scene, the evidence 'could be contaminated', so is also not relevant. Since Joe testified one way and then recanted, his recantation is not relevant.
How can this be? How can we allow someone to sit behind bars for his entire life because someone else pointed a finger at him without any true evidence to back up the claim?
David been denied assistance by innocence projects and advocates because Joe's contribution to David's conviction is so difficult to overcome. I have been told by attorneys, innocence projects and the media that as soon as I "solve the crime", they'll be happy to come on board and tell David's story. We're interested in JUSTICE, not publicity. The only publicity we want is the publicity that will tell David's story and set him free. But that help has been elusive. The truth will set you free? Not in this case.
