Olshan client Engaged Capital announced that it has reached an agreement with Benchmark Electronics Inc. where Engaged Capital will have the right to request for Benchmark’s Board of Directors to identify a mutually agreeable, independent director to be added to the Board.

Thomas Fleming and Jaclyn Grodin are representing the plaintiff in an $18 million lawsuit involving a real estate deal in which the defendant signed a purchase and sales agreement in February 2016 to sell 82 buildings to the plaintiff. The lawsuit states that the defendant had intent to defraud by falsely claiming to have full power to sell the 82 properties. (CLICK LINK TO READ MORE)

On November 18, 2016, the Federal Communications Commission’s (“FCC”) Enforcement Bureau released an Enforcement Advisory clarifying the Telephone Consumer Protection Act (“TCPA”) limits on the use of autodialed text messages—commonly known as “robotexts.” The FCC confirmed that its rules restricting the use of automatic telephone dialing systems—“any equipment that has the capacity to store or produce numbers to be dialed and dial them without human intervention” (CLICK LINK TO READ MORE)

An important legal ruling is expected soon that will have far-reaching impact on the telemarketing and  debt-collection industries. In October, oral argument was held before the United States Court of Appeals for District of Columbia Circuit in a case entitled ACA International v.
