What To Do At A DUI Checkpoint (https://goo.gl/cd7K1j)

DUI Checkpoints are popping up more and more. Whether you've been drinking or not, if you're driving at night you should be prepared for a DUI checkpoint. While it's important to follow the rules, it's also important to know your rights.

If you are asked to stop, you must stop.
Law enforcement often makes random stops using a pattern, but if you are asked to stop you must do so. Stay calm and follow the officer's instructions.

Provide your information.
The best thing to do is roll down your window and provide the officer with your driver's license and vehicle registration. Failing to do so may cause suspicion, and lead to an arrest.

Do not break traffic laws.
While you are legally allowed to turn around if you see a DUI checkpoint up ahead, you can't make illegal u-turns of maneuvers in order to do so. That could be enough to pull you over, and it could lead to suspicion that you've been drinking and driving.

Don't incriminate yourself.
Many people feel that telling the police they've had a beer or two will help them, but it could actually be used against you in a DUI case. Instead, politely decline to answer the question.

If you've been arrested in Terre Haute, Indiana or the surrounding area, you should contact a lawyer immediately. At Rowdy G. Williams Law Firm, your case becomes our case. DUI Myths (https://goo.gl/9mQtRt)

If you are convicted of a DUI, you may face consequences for the rest of your life. This week, we're talking all about DUI charges in Terre Haute, Indiana.

Today, we're starting by debunking some of the common myths about DUIs.

You can only be charged with a DUI if you're caught behind the wheel.
If a police officer seek you acting drunks, and knows that you were recently behind the wheel, you can still be charged with a DUI.

If you're careful, you won't get caught.
More than a million people are arrested in the U.S. every year for driving under the influence, and DUI checkpoints are continuing to pop up in cities and towns across the country. It is easier to avoid drinking and driving than deal with the consequences after the fact.

You won't be charged unless you blow a .08 or higher.
While .08 is the legal drinking limit, you can still be charged with a DUI or a different driving impaired charge if your BAC is lower than .08.

If you've been arrested in Terre Haute, Indiana or the surrounding area, you should contact a lawyer immediately. At Rowdy G. Williams Law Firm, your case becomes our case. You Can Make Changes To A Prenup (https://goo.gl/dyi9RT)

While the work prenuptial itself indicates that the agreement is made before the marriage, it doesn't mean that once you do it is set in stone.

People decide to have pre-marital agreements for a wide array of reasons, and sometimes circumstances change. Pre-marital agreements can be amended or even revoked if both parties agree on it, just as any other legal document.

Conversely, if you and our partner did not get a pre-nuptial agreement, but you are interested in creating an agreement to protect your assets, you can have a postnuptial agreement drafted up by your family law attorney.

Whether the agreement comes before or after you tie the knot, your family law attorney can walk you through the whole process. Open communication is a cornerstone to any marriage, so having a conversation with your spouse or soon-to-be spouse doesn't have to be an unpleasant experience.

If you're considering a prenup or postnup, or there are changes to your existing agreement that you'd like to make, call Rowdy G. Williams Law Firm to learn more.

What To Include In Your Prenup (https://goo.gl/S3jLQk)

If you and your partner are considering a prenuptial agreement, it's important to start preparing it well in advance of your wedding day.

If you're just starting to suss out the details, here are a few things you may want to include in your premarital agreement:

Property
Any property that you have coming into the marriage can maintain your separate property in the event of divorce, including any increase in value or any income made from that property.

Gifts
You can state in your prenup that gifts from your spouse during the marriage are your separate property.

Retirement
If you have a 401K, an IRA, or any other retirement accounts, those can be considered your personal property.

Estate rights
In many places, if you are married and you don't leave a will, your spouse automatically gets rights to at least some of your estate. You can waive those rights in your prenup if you wish.

Debt
You can protect yourself against your partner's debt entering your marriage by including this stipulation in the prenup.

The ring
If you'd like to protect your engagement ring in the event of a divorce, you can list it as separate property in your prenup.

"The Rowdy Williams team was very effective and efficient. Whenever I called the office, the support staff were immediately helpful in answering questions and concerns that they could and passing along messages to Mr. Williams and Mr. Brewer. The legal team presented me with worst and best case scenario as it pertained to the outcome of my case but expressed confidence in the best case for the entire 6 month process and they definitely delivered. The bulk of my case was wrapped up in 6 months and the decisions made were the best case scenario for me. Mr. Williams even reached out to me after the dust had settled to ask how I was doing and make sure things were still going well. I definitely appreciate what the Rowdy Williams Law Firm team has achieved for me and I encourage anyway with any sort of criminal law needs to reach out to the Rowdy G. What Exactly Is A Prenup? (https://goo.gl/TL6TsN)

Prenup is the slang term for a pre-marital agreement, a legal contract signed by both parties prior to a marriage.

A pre-marital agreement can protect assets that you own individually and keep them separate in the event of a divorce. A pre-marital agreement can even include additional provisions for the division of marital property, payment or spousal maintenance, and attorney fees.

There are certain things, including child custody and child support, that cannot be determined by the pre-marital agreement. Still, for most things, a pre-marital agreement helps a lot in the event of death or divorce.

If you are considering drafting or signing a pre-marital agreement, you should first consult a Terre Haute family lawyer. A family lawyer can review the agreement, address any of your concerns, and help you understand the contract language. They can also help you negotiate for any changes to the agreement.

Millennials And Marriage: Are They Avoiding It Altogether? (https://goo.gl/yuepUd)

We've talked about how millennials putting off marriage until they're older and more educated has resulted in a decrease in the divorce rate in the U.S., and that more millennials are getting prenuptial agreements than other generations, but could the numbers really be showing that millennials aren't really interested in marriage at all?

A recent Urban Institute report is predicting that an unprecedented portion of millennials will remain unmarried through age 40. The marriage rate may soon drop to 70%. For comparison's sake, the marriage rate for Gen Xers is 82% and for boomers it's 91%.

According to a report released by the Pew Research Center, 25% of millennials are likely to never be married. That's doesn't necessarily mean that they'll be single forever. Nearly a quarter of unmarried adults ages 25 to 24 live with a partner, they just put off marriage for later, if at all.

Though marriage has lost much of its social allure, about 70% of millennials still say they want to get married. Many cite unstable economic circumstances as a reason marriage is out of reach.

You can read more about the decline, and possible causes, here: https://goo.gl/yuepUd

How Many Millennials Are Getting Prenuptial Agreements? (https://goo.gl/w7zhwj)

In our last post, we talked about how a new study may reveal a decrease in the divorce rates, thanks to millennials in particular.

With lower divorce rates among millennials, and less millennials getting married in general, we wanted to know: Are millennials getting prenuptial agreements?

The answer is a resounding yes.

A recent study cited a boost in the number of millennials requesting prenuptial agreements, according to the American Academy of Matrimonial Lawyers. Only 2% of those surveyed reported a decrease in prenups among 18- to 34-year-olds.

62% of lawyers polled have seen an increase in the number of clients who are seeking prenups during the last three years. One reason may be that since millennials are entering into marriage later in life, they may have more to protect. Since they are also entering into marriage more educated, they may also have debt to protect against.

You can read more statistics about millennials and prenups here: https://goo.gl/w7zhwj
