As in any legal matter, the individual has the ability to represent themselves or go forward pro-se. However, there are specific requirements which are needed, depending on the type of injunction. There are specific requirements which must be included in the petition for a judge to have a basis to either grant an injunction or to set the case for hearing. There are also specific elements which must be met for an injunction to be entered at a hearing. If your ex-husband or your ex-wife is sending harassing or threatening e-mails or text messages, you may have the basis to proceed with an injunction or a restraining order against that person.

You should save copies and screenshots of the messages and call logs at issue to assist with your case.

You may have a child in common so there could be a legitimate basis for some of that communication, but if you’ve made it clear to your ex-spouse the communication is solely to be limited to the child and the child’s well being, and the communication goes beyond and is harassing you about where your are, who you are with, and other things of a personal nature that are not relating to that child, you could use that for the basis for the #injunction or restraining order to prohibit that person from harassing you.

You may have a basis for the crime of #stalking. If there are credible threats in those messages, the crime rises from a misdemeanor in Florida to a felony.

Are #victims of #cyberbullying or #cyberstalking protected by the #law?

In Florida, victims of cyberstalking and cyberbullying are protected by the law. They have the ability to go forward with an injunction or a restraining order, which prohibits direct and indirect contact with the victim. That means the offender can’t message the victim, can’t post on social media about the victim, can’t show up at the victim’s house, or at their work. That also prohibits the indirect contact with reaching out to the victim’s family or friends to try to get messages to the victim. The victim also has the ability to report the incidents criminally.

Cyberbullying and cyberstalking are included under the criminal stalking law of Florida. If victims want to report this incident to police, the police can then provide this information to the state attorney’s office to review for criminal charges of #stalking.

The victim may also have other civil remedies available depending on the nature of the allegations in the specific case.

Attorney Stephanie Cagnet Myron appeared on CBS 12 News tonight to discuss a local rape case. She also discussed issues with the testing of related rape kits and the recent law in effect as of July 1, 2016, which provides for 30 days for law enforcement to submit the kits for testing, and for the tests to be completed within 120 days.

The 30 days time limitation begins when law enforcement receives the kit or when a victim requests the evidence collected from their forensic exam be submitted for testing – see F.S. 943.326 (1)(a).

Florida law requires emergency facilities to provide a forensic rape exam at no cost to the victim. Here in Palm Beach County, law enforcement will provide transportation to Butterfly House, which is the medical facility that assists victims of rape and sexual assault.
