Tachograph Offences, Drivers’ Hours and Card-Pulling: An Essential Guide for HGV and PSV Drivers

For many years the tachograph system has been central to the European haulage industry. Without it, the enforcement agencies (DVSA / police / Office of the Traffic Commissioner) would have no reliable or practical way of policing the rules on working time and drivers’ hours.


But what happens when a driver uses the tachograph system incorrectly, or worse still, when the rules are deliberately broken? Missing mileage, card pulling, forging of tachograph data – all will very quickly land drivers and their employers in hot water.

Being Interviewed by the DVSA (VOSA) can be a Sharp Wake-up Call – Don’t Ignore It!

Every year, thousands of operators are interviewed under caution by the DVSA (formerly VOSA). This often follows a compliance investigation at their premises. The evidence gathered at these interviews is recorded, and can be used as evidence in a future criminal prosecution. It can also be used at a Public Inquiry before the Traffic Commissioner.


In short, operators who underestimate the importance of their DVSA interview and fail to prepare properly, do so at their peril.

Do I Need an Operators’ Licence? (Goods Vehicles)

This is a simple question which is not always simple to answer. The Operator Licensing system is complex and there are many exemptions that may or may not apply to you. The reality is that you should always get specialist advice or you could find yourself applying for a licence that you do not need, or worse – facing a conviction for operating without a licence!

The Traffic Commissioner’s “Seven Deadly Sins” – Have you committed any of them?

There are a wide range of powers open to the Traffic Commissioner if an operator is found to be breaking the rules. Some infringements are dealt with by way of a simple formal warning letter, whilst others can result in a total licence revocation and the disqualification of all the directors involved in the business.
