Republicans delivered their sweeping plan to an exultant President Donald Trump, who signed it into law Friday. One provision scraps a 75-year-old tax deduction for alimony payments. The new rules won't affect anyone who divorces or signs a separation agreement before 2019.

Many divorce experts worry that the change will make negotiations tougher and lead to less spousal support as cash goes to taxes instead. Congressional tax writers say it's only fair to married couples.

When a custodial parent receives cash aid from the State of California on behalf of a minor child, the issue of child support comes within the jurisdiction of the Family Support Division. The receipt of aid divests the Family Court of jurisdiction to hear the child support issue, without the County of San Diego having a representative involved.

In a dissolution matter involving retirement accounts, a Qualified Domestic Relations Order or “QDRO” is required. This is an order in addition to the Judgment of Dissolution required for the divorce. The QDRO orders the retirement plan to transfer or divide the retirement benefits to the non-employee spouse pursuant to the Judgment of dissolution. Such transfer won’t occur until a certified QDRO is approved and received by the plan.

“Everyone said "do not get a lawyer for your divorce, it will cost you an arm and a leg and they rarely actually get anything done. In addition, all they want is your money and will try to cause litigation situations just to go to court, then you are talking tens or hundreds of thousands of dollars". I found this statement to be completely false with the office of Dawn Dell'Aqua. In addition, I have referred about 6 people and all who have used her have said that she helped them tremendously and are quickly getting things accomplished where other lawyers were not. I have never heard a negative thing about Dawn and her law office. She is professional and has an excellent, knowledgeable assistant that helped me keep costs down. She protects her clients and tries to keep things out of the courts if possible. In divorce situations she encourages mediation but if that is not possible, is VERY good at protecting her client and doing the right thing by her client. She is honest and forthright and does not waste your time with suggestions that won't fly with the court system. I highly recommend the Dawn Dell'Aqua law office to anyone for any and all services she provides. She is honest and credible and excellent in knowiong her stuff. In the courtroom if you need to go there. As one of the friends I recommended said to me "When Dawn speaks, the court listens”

In cases handled by the Family Support Division, the attorneys employed by the DCSS have the responsibility to enforce and collect child support orders for families who are receiving assistance from the state or in cases where the parent has requested enforcement services.
What can be confusing for families is that the attorneys at DCSS are not their personal child support enforcement Attorney. They are involved in the case to represent the County’s interests, not the party’s interests. These attorneys handle a high volume of cases every year and the cases can take considerable time to be resolved.
