yet another setback for Apple in its attempt to stop it´s extremely succesfull competitor in court

Initially it all seemed to go well for Apple in its relentless war against Samsung. It got an injunction in Germany and in Australia. Both against the tablets on the basis of copy-catting the design. Most reports never mentioned that in a more encompassing case in the Netherlands, the main port to Europe, Apple lost it´s case against Samsung on almost all counts.

News tended to focus on the two countries where Samsung could not release it´s tablet. In Germany sales just went on as the large retailers just used the mainly Dutch channels to get stock. In Australia Samsung fan had to import themselves or go through mail order companies.

Today, the full federal court assembled in Australia and overturned the decision of judge Annabelle Bennet. She had initially ruled that it was likely that Apple would be right in it´s accusation and had imposed a full stop on all sales in Australia until the full court would rule.

So today they convened and on every aspect the initial judge used they took the opposite stance. Not only did they discover several errors in the initial judgement and the underlying facts, but they also disagreed with her treatment of the case. She did not weigh the evidence in a balanced way it was ruled today so the decision has been reversed.

Apple has immediately appealed by stating they want to go the High Court and meanwhile want to block Samsung from selling during this profitable month. The judges already weighted all the evidence and find it extremely unlikely that the High Court will even accept the case but if they do they are confident it will have the same outcome as their ruling.

So to be clear: no court in Australia so far has judged on the question if patents of Apple were violated. All that has happened was that a lower judge was too trigger happy and based on Apple´s complaint only immediately blocked all sales in Australia. This has been undone in no uncertain way. Legally it seems next to impossible that Apple will be able to succesfully appeal. It needs a special permission to do so and Apple´s lawyers will probably realize it´s a waste of time.

In my personal opinion like I just commented:
Preliminary injunctions in these cases should be stopped anyway as the commercial interests are too large and the lawyers at both sides too smart. They trick a judge in blocking a product. It´s an effective weapon against a new rip off "Rolex" manufacturer or others who clearly violate crucial patents and would harm sales of the original manufacturer.
In this ongoing stream of Apple´s attempts to block sales of competitors on markets judges should be more prudent.

Anyway Apple will as good as certain have to pay for the damages Samsung suffered as they were the one who filed for the import stop. In these cases it´s normal that you compensate the other party if you were wrong in your demand. Not 100% sure about Australian law though but in Europe and as far as I know the US this is the case.
Will check on it and add it if I´m 100% sure. Aussie experts are welcome to comment.

If Samsung moves fast the shops can still be filled for the Christmas shopping spree and the Aussies will have their Samsung 10.1 tablet off the shelf which so far they had to import themselves.
Samsung has to wait until Friday as the judge will then decide on the last feeble request of Apple to uphold the injunction until it goes to High Court. I´m willing to bet a Galaxy 10.1 tablet on it that this weekend the shops in Australia will be full of Samsung tablets.
