In an op-ed published Saturday, state Sen. Same-sex marriage has been legal for almost two years, but opponents are looking to fight a U.S. Supreme Court ruling through a lawsuit challenging Houston's benefits for same-sex couples. Equality Texas today filed an amicus brief with the Texas Supreme Court in the case of Jack Pidgeon and Larry Hicks v. Mayor Sylvester Turner and City of Houston (formerly Pidgeon et al, v. Parker). Equality Texas filed the Amicus Brief on behalf of 35,000 Texans, including married LGBT Texans like L.J. and M.P. whose rights are directly implicated by this case. Directive or no directive, Title IX still prevents sex-based discrimination and courts have held that discriminating against transgender kids is sex-based discrimination.

"The larger takeaway is, this is a study that can begin to make a connection between policies or laws that either affirm or stigmatize people and their psychological and physical health," Chuck Smith said. "If laws and policies are enacted that are affirming of lesbian and gay people's sexual identity, that actually can have an effect of reducing the triggers that could negatively impact mental and physical health."

The CEO of Equality Texas, Chuck Smith, said while religious liberty is protected by the constitution, it doesn't mean people should be allowed to use that liberty against others.

"If they are offering services to the general public as a whole then they need to do that fairly and equally to all people," said Smith.
