The Law Offices of Jean-Charles S. GARDETTO, founded in 1988 by Jean-Charles S. GARDETTO, a member of the Monaco Bar and a former President of the Bar association, are a Monaco-based law firm working in the areas of litigation and legal advice. They provide their local and foreign clients (individuals and corporate entities) with the legal expertise of a team that, through the complementarity of its members, is in a position to handle any legal issue before any court, to advise on the implementation of a wide range of projects and to assist clients wishing to settle in the Principality of Monaco. MONACO: NEW LAW ON INTERNATIONAL PRIVATE LAW

Law n°1448 of 28 june 2017 regarding International Private Law was published last friday in the Monaco official gazette. This new law is quite complex and covers jurisdiction of the Monaco courts, recognition of foreign judgments and foreign public deeds, conflicts of laws, personal status, marriage (in particular matrimonial regime, divorce and separation...), filiation and adoption, alimony and financial compensation, estates, contractual and non contractual obligations, assets, trusts. Among other things the new law allows the parties to choose the law applicable to their matrimonial regime, their divorce, and their estate. It conveys substantial changes in Monaco practice. We now need to see how the courts will understand the new provisions.

Jean-Charles S. Gardetto participated to the IBA 21st Annual International Wealth Transfer Practices Conference held in London on March 1st, 2016. He was a panelist on the subject of "I want somewhere with good schools, stable governement and culture, but I don't like to pay too much taxes. What should I do before I emigrate? Pre-immigration tax planning. Jean-Charles spoke about tax residency issues, taxation of passive income, inheritance tax, classic estate planning tools and interaction with other jurisdictions in Monaco.

RECOVERIES OF FOREIGN ASSETS

Jean-Charles S. GARDETTO, Managing Partner of the Law Offices of JC S GARDETTO www.gardetto.mc ,  was invited  to the Creditors' Club in Kiev on 28th May 2015 by the international law firm INTEGRITES. He spoke about recoveries of foreign assets in Monaco and presented the provisional measures available to creditors as well as the procedure for the recognition and enforcement of foreign (Ukrainian) judgements. 
Over 120 representatives of leading Ukrainian financial institutions and government agencies attended the event .
The meeting was organized by the international law firm Integrites, together with the VTB Bank, Bank Credit Dnepr, Piraeus Bank and BTA Bank, and with the participation of the foreign legal firm Simmons & Simmons (UK), CEE Consulting Group (Poland), Braun Partners (Czech Republic) R & P Legal (Italy), SORAINEN (Latvia), Lalive (Switzerland), Jean-Charles S. Gardetto (Monaco), Advocatio Rechtsanwälte Grabher Dür (Liechtenstein), Nasos A. Kyriakides & Partners (Cyprus) and Gleiss Lutz (Germany).
