Assignment of benefits is an issue that is really blowing up homeowner's insurance premiums. Changes are in the works to eleminate this loophole that allows some contractors to take advantage of homeowners and their insurance companies. For now, the best thing to do is never sign an assignment of benefits agreement.

If you are a homeowner, be aware of the fraud that is occurring in Florida at an alarming rate. The issue is refferred to as "assignment of benefits."

Here's how it's happening:

A homeowner discovers that a pipe has broken and there is flooding inside the home that is damaging the house and furniture. The homeowner calls a restoration company to urgently come stop the flooding and dry up the home. The contractor arrives and asks the homeowner to sign an assignment of benefits form before work is started. If the homeowner signs it, the restoration company will choose any other contractor needed to repair the damage and will be the party that receives all payout from the insurance carrier for that claim. The homeowner is excluded from the decision making position and from receiving any compensation.

Obviously, the above scenario leaves the door wide open for fraud.

California has been granting driver's licenses to illegal aliens. This has lead to a substantial increase in the number of uninsured drivers in the State. If one of these drivers were to cause and accident with injuries, the other driver needs to have uninsured motorist bodily injury (UM) coverage on their policy.

UM will give the injured (not at fault) driver and passengers a way to file claims for the injuries they sustained. Claims for such things as medical expenses, lost wages, pain and suffering, loss of consortium, and more can be filed. It's very important coverage.
