New Braunfels “Can Ban” Ordinance Has Been Upended!

The New Braunfels district court office, headed by Judge Don Burgess, has recently favored the proposal of Austin attorney Jim Ewbank with regards to the controversial city ordinance which limits the cooler size that tourists can bring during picnics. According to Ewbank, “He (Burgess) has declared both the container ordinance and the cooler ordinance to be unconstitutional and unenforceable.”

The city ordinance that was filed back in 2007 restricted certain sizes of coolers. This and the can ban that was filed in 2011 was used mainly in order to prevent people from bringing beer cans and other disposable beverage and food containers to the Guadalupe and Comal rivers, especially in areas which are located in the city limits. With the city ordinance in effect, tubers are only allowed to carry 1 beverage container or a cooler with a capacity of 16 quarts. A $500 fine is imposed to the violators of the anti-litter ordinance.

Various tubing businesses who are not in favor of the ordinance quotes that the rivers are considered to be “waters of the state” giving the state full rights to regulate the rivers, not the city. Furthermore, Ewbank, who is on the side of the plaintiffs, also brought different bottles and containers to the court showing that the city ordinance is vague and that people may have difficulty in determining the legality of the containers. He further states, “It’s confusing to the average person who tries to figure out if they’re going to get a ticket if they buy that water bottle.”

The city’s attorney, along with Mayor Gale Pospisil who has recently heard the news, commented that, “This last summer was so good — and the sales tax and hotel tax numbers are up, I know that some businesses suffered initially, but it appears things are improving.”

“I’m terribly disappointed and I’m sure a lot of our citizens are going to be disappointed, too. It’s very discouraging” the Mayor said, preparing for a closed door meeting with the city council as soon as she heard the news.

While the tubing business is happy for the recent turn of events, Attorney Val Acevedo of the city attorney’s office states that the ordinance will still take effect until both parties received a signed order from the judge regarding the ruling. Ewbank is currently preparing the order for possible signing within the week.

The cancellation of the two city ordinances will most likely boost the sales of various river tubing businesses in the area. It will also boost the sales of various beverages consumed at the river. Without the city ordinance, people will no longer be afraid of getting a ticket for bringing any type of drink, regardless of the container size. With this, the number of tourists visiting the place is also expected to increase. However, let us not forget the real essence of the ordinance, with the expected growth of the river tubing business, it would also include the responsibility of keeping the rivers clean and litter free.

Floating down the Comal is like no other experience I have ever had. The peaceful crystal, clear waters combined with some of the most beautiful scenery Texas has to offer will surely make this an unforgettable experience. Tubing down the Comal with friends and family is the perfect way to spend a quality day under the big Texas sky.

This was an awesome tubing experience! It was fun and easy. The staff was very friendly and helped us rent our tubes. They are really organized and fast at getting people in and out to enjoy the Comal River. There wasn’t much of a wait for neither the tube rentals nor the shuttle. We chose to celebrate my friend’s birthday by floating the Comal River. Comal Tubes took care of us and my friend had a memorable birthday celebration. I totally would recommend going to this place again.

My family and I really enjoyed our experience floating the Comal River on July 1, 2013. This was our first time going and we've lived almost 7 years in this area. The temperature was great and so was the environment. We enjoyed our experience there and would definitely recommend it to anyone. We would really love to go again soon :)

Bad experience, especially with the Groupon. I have been tubing for years and have never paid as much as I did despite having the Groupon - there was mention of the shuttle, but not the upcharges (like bottoms for tubes and such). The shuttle was the dirtiest, it's located too far from the river, and the customer service was lackluster. The only upside was the parking, which is what saves this place from one star.

We went as a family and we LOVED it! From dad having fun watchin all the college kids to our kids 'behaving' to be COOL kids and even went down the road to Rudy's BBQ after. Great place! MUST ADD IT TO YOUR TRIP!!!

Comal Tubes is the perfect place to rent your tubes for a float down the Comal River. The people are so nice, and make sure to be there to pick up when you are through floating. Also, an easy walk from Comal Tubes to the river if you don't want to shuttle. I will always choose Comal Tubes! Great people, great fun!
