In an interview with the Economist, published on May 11th, President Donald Trump announced ‘a very massive overhaul’ of Dodd-Frank, the act signed into federal law by his predecessor President Barack Obama in 2010. Dodd-Frank promised to prevent another global financial crisis through regulations and government control, but under President Trump the US Financial Services Committee has approved the CHOICE Act for consideration by the full House of Representatives. What does this mean for call recording and compliance?

An emphasis of this new legislation is putting control into the hands of the consumer – removing the option of ‘opt-out’ consent and ensuring that users explicitly consent to their data being stored and used by organisations. With failure to comply resulting in fines of €20m or 4% of annual turnover , whichever is higher, the onus is on businesses to document their data protection processes and incorporate ‘privacy by design’ into the architecture of their organisation.

Hosted telephony largely appeals to both small and large businesses due to the lack of CapEx required to implement the system. There is no hardware necessary, which reduces the storage space required as well as power costs associated with running servers. With on-premise PBX options there are also installation costs on top of hardware expenditure. Larger organisations will have greater CapEx, as costs only increase with the size of the hardware required.
