Last month in Anderson v. Sun Life, the Ninth Circuit ruled in favor of our client Nurse Diana Anderson that Sun Life's self-serving interpretation of its own ambiguous disability insurance policy was incorrect. After Nurse Anderson injured herself on the job, her employer gave her a temporary accommodated position (to allow her to recover) calling discharged patents to assist them with their discharge orders. When it became clear that she would never be able to return to work, Sun Life gave her the runaround, and finally denied her long-tern disability benefits on the basis that the was no longer a nurse, but a phone agent. The Ninth Circuit saw right through that, and in a matter of days, Nurse Anderson is going to have the disability benefits that she's entitled to, and for which she has been waiting years. Calk up another win for the good guys!
