The mother of a young boy has filed a dog bite lawsuit on behalf of her son, who was violently bitten in the face by a bull mastiff at a county operated animal control shelter in Yorkville, IL. Like many dogs taken to dog shelters, Moose (the bull mastiff) was taken away from his owners after he bit a mail carrier in the arm— requiring fifteen stitches to close the wound. Yet despite the dog’s documented past violent acts, the county never warned visitors to the dog shelter about Moose’s potential propensities.

Severe dog bites to child

Accompanied by his father to the dog shelter, the boy was bitten as he attempted to pet the dog. According to news reports of the incident, the dog bites to the boy’s face were so severe that he required a hospitalization and surgery. As a result of the incident, Kendall County Animal Control has changed its policies regarding who may have contact with dogs at the shelter. Under the new policy, no volunteers under 18 can have direct access to the dogs.

Provocation in dog bite cases

From a legal perspective, there is little chance that any allegations can effectively be made that the boy somehow provoked this dog. Courts in Illinois and other jurisdictions have routinely held that the simple act of petting a dog does not constitute provocation. Because this dog has repeatedly caused problems, I hope that Moose receives an evaluation from a properly trained expert in animal behavior to determine if this dog can be rehabilitated or if, in this case, the dog must be euthanized in order to protect the public.

While we await the outcome of this dog bite lawsuit, I wish this little boy the best. In addition to getting medical attention for his dog bites (and assumed scars), I hope that this family considers getting some counseling for this boy to help deal with the fear and anxiety that accompany serious dog bite attacks.

Hopefully, this child will learn that dogs can indeed be peaceful, loving creatures. From the perspective of the facial scar from the dog bite, I hope that that all medical options are considered by the family as scars are generally better addressed soon after an attack as opposed to allowing the boy to develop through adolescence and then seek treatment.

After reading an article concerning dog attacks in Britain, I was left with the impression that the classy people across the pond have just as much of an animal control problem as we do in the United States.

Hospital data from admissions related to dog bites over a five-year period was evaluated and reporters found that the number of people seeking medical care for dog bites increased by approximately 13% over the prior five-year period.

At one hospital alone, more than two people were hospitalized every day for dog bites— with a significant percentage of the bites originating from a younger group of children under sixteen years of age.
