Major relief to #NRI mother in child custody case:

#Fortunelegal Advocates successfully obtained a favorable order in a child custody case. In the present case the father of the child filed a writ of Habeas Corpus in the Delhi High Court seeking the child’s custody on the basis of order passed by circuit court of Montgomery, Maryland, U.S.A. Appearing for the mother Mr #Pankaj Mehta and Ms. Shweta Soni apprised the Courts that the Order of American Court cannot be executed in India as India is not a party to the Hague Convention of of 1980 on “Civil Aspects of International Child Abduction” and welfare of the child must be seen before giving custody to any of parents in such cases.

While disposing the Writ Petition filed by the husband, the divisional bench of Hon’ble Justice Vipin Sanghi and Hon’ble Justice I.S. Mehta held that welfare of the child is of paramount importance in such proceedings and that has to be kept above all other factors since this court exercises its jurisdiction as parens patriae.

Further, the Hon'ble Court observed that while dealing with habeas corpus petition, it doesn’t function as an executing Court in respect of the orders obtained by the Petitioner from the foreign courts and thus the petition has no ground to stand on. In closing, the Hon’ble Court held that being in the custody of the mother will be in the best interest of the minor child.

The Supreme Court today extended deadlines for linking Aadhaar with existing bank accounts, PAN, mobile phone numbers, and various other services indefinitely, till a judgement is pronounced in the matter.However, Aadhaar number would still be required for opening new bank accounts or applying for Tatkal passports.
The Apex court also ruled that the government may continue to seek the 12-digit national biometric identifier number of beneficiaries for transfer of benefits of schemes funded from the consolidated fund of India. Thus, March 31, 2018 continues to be the deadline for linking Aadhaar to subsidies, benefits and services prescribed under Section 7 of the (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016. #Aadhaar

Supreme Court says foreign law firms can’t practice in the country, allows foreign lawyers to visit India on a ‘fly in and fly out’ basis for giving legal advice to clients in India about foreign laws, and to participate in international commercial arbitration.


Justice Goel, while pronouncing the judgement, said that even for the limited purposes they would be subject to the Bar Council of India's Code of Conduct.

Passive Euthanasia allowed by the Apex Court:

In a landmark decision, and upholding the right of human beings to die with dignity, the Supreme Court on Friday allowed passive euthanasia, or withholding treatment essential to life for a terminally-ill patient.

The five-judge Constitution bench headed by Chief justice of India Dipak Misra also sanctioned living will, a document that allows a patient to give explicit instructions in advance about the medical treatment to be administered when he or she is terminally ill or no longer able to express informed consent. It also issued guidelines in governing execution of living will and passive euthanasia in the absence of living wills. #Euthanasia #LivingWill
