*MOM WAS APPOINTED ADMINISTRATOR OF MY FATHER'S ESTATE.
WE SET UP AN ESTATE BANK ACCOUNT. HOW DO WE CLOSE THE PROBATE ESTATE?
 I WANT TO CLOSE THE ESTATE BANK ACCOUNT AND CLOSE OUT THE PROBATE ESTATE.  HOW DO I DO THAT?*

George's answer:

In a typical New York estate, after all assets have been collected, debts paid and after seven months have elapsed since the issuance of Letters of Administration (the time creditors have to present their claims) the estate's attorney will prepare an informal accounting (informal in the sense that no no petition is filed with the court) and send it to the beneficiaries. If the beneficiary are in agreement with the accounting, they will be asked to sign "Release Receipt and Waiver" forms after which they will be paid their bequests and the estate is effectively "closed.".
A judicial accounting which seeks court approval of the fiduciary's account is usually only resorted to if there is disagreement among the beneficiaries and the fiduciary concerning the administration of the estate or there is some other issue which requires court approval, e.g. the fiduciary wishes to purchase estate property or one of the beneficiaries is under a legal disability.

SHOULD I BUY A HOUSE THAT HAS BEEN REMODELED (NEW DORMER AND BATHROOM ALONG WITH A COVERED PORCH) WITH NO BUILDING PERMITS?
 
George's answer:

You should be concerned. The standard contract, at least the one used in the New York Metropolitan area, requires the seller to provide certificates of occupancy or "C of Os" for the home and any improvements (dormers, extensions, decks, etc.) You will find it difficult to get financing for the purchase of a home without such C of Os and even if you're buying "all cash" you will run into problems if you ever wish to sell the home.

IF A PARENT HAS PASSED AWAY, ARE THE CHILDREN ENTITLED TO THE ESTATE LEFT BEHIND, OR DOES IT SOLELY BELONG TO THE SPOUSE?

George's answer:

In addition to an intestate share going to a surviving spouse (first $50,000.00 plus one-half of the remainder) a surviving spouse is entitled to certain "exempt" property including $25,000.00 in cash, a vehicle worth up to $25,000.00 and household items worth up to $20,000.00. Also, any assets held jointly with the surviving spouse or which named the surviving spouse a beneficiary would not be part of the probate estate subject to the laws of intestacy but rather would be payable to the surviving spouse by operation of law.
