...but if I was not convicted, why do I have a criminal record? In NJ, the criminal record is created when you are charged with a crime, not if/when you are convicted. That arrest record does not disappear, unless it is expunged pursuant to Court Order. The New Jersey Expungement Statute requires a process of paperwork, called a 'Verified Petition', that lays out when the criminal record was created; what crimes you were originally charged with; the docket number of the criminal case; the case or indictment number if they were ever generated; whether any amendments to those offenses were ever made; and, the disposition of all charges including dates of conviction, sentencing, diversion, dismissal. If there was a conviction, the statute imposes a 'waiting period' before you can apply for an expungement. The process must be supported by attaching documents supporting the claim to have the information about the charge removed from your record. Under all circumstances, the process takes months to obtain an Order allowing the removal of the information, and must be backed up with both fingerprint and on-line background check several months later to ensure that all data has been removed from public view.
