Wrong-site brain surgery leaves woman unable to speak or walk
Brain surgery was supposed to help a woman who had been suffering from mini strokes for several years. Surgery might have helped, if the surgical team had operated on the right side of her brain. The 53-year-old woman was due to have a craniotomy bypass on the left side of her brain, but doctors operated on the right side of her brain. The woman now uses a wheelchair and cannot communicate. 

The wrong-site surgery happened despite the fact that the woman’s head was correctly marked for surgery. To find out how the hospital and neurosurgeon apologized for the medical error, read our blog entry on the topic.

This is a heartwarming article about a couple with disabilities.The woman in this story had hydrocephalus at birth, which means a buildup of fluid in her brain caused brain damage. As a birth injury, hydrocephalus is sometimes caused by medical negligence. Although it is not clear what caused the woman's condition, the story shows how challenging it can be to live with a birth injury.

Heart-wrenching post about how medical negligence profoundly affected, and continues to affect, one family. Their son was born with cerebral palsy, in this case, a birth injury caused by the failure of medical professionals to recognize signs of fetal distress.

Pursuing a medical malpractice claim can often be a difficult decision but it is necessary for at least two reasons: A medical mistake can result in substantial medical expenses that a family may not be equipped to handle on their own and holding a doctor, hospital or nurse responsible for the effects of their mistakes is one of the best ways to stop the same mistake from happening again.
 
Birth injuries are a common cause of cerebral palsy. More often than not, they could have been prevented. Many families blame themselves for their child’s disability. This was the case with our friend, Terresa Gaither. Her son, Bailey, was an unfortunate victim of medical negligence which resulted in him having brain damage at birth. Brother, sister talk about botched kidney transplant last year

One of the most difficult aspects of a surgical error is that the effects can long lasting or permanent. Last year, a transplant team in Ohio made an unthinkable error: A nurse accidentally threw  away a kidney that a man had intended to donate to his sister. Recently, the story has come into the news again, as the brother and sister have filed a medical malpractice claim and have begun to talk about the terrible effects the hospital’s mistake has had on their lives.

The man was 21 at the time of the surgery. His sister was 24 and struggling with end-stage renal disease. In a recent interview with ABC News, the brother described waking up from surgery and realizing that while he was in pain, his sister was walking around. 

The sister described how happy she was when she learned that her brother’s kidney was a match, and how she woke up from surgery with the feeling that something was wrong. Then she realized there was no incision. She received a kidney three months later, at a transplant facility in Colorado, but says the entire ordeal was devastating.

The family has filed a medical malpractice lawsuit against the hospital, which denied wrongdoing this week.

A recent article in The New York Times discussed how difficult medical malpractice lawsuits can be for doctors, citing a recent study. The author also wrote of a colleague who said she had lost a year of her life to a medical malpractice claim.

In a response, the website Take Justice Back pointed out that many victims of medical malpractice lose more than a year -- they lose their lives. Check out the rest of Take Back Justice's response.

Who Should Be Held Responsible For Nursing Home Injuries Caused By Bed Rails?

Was the manufacturer negligent - did it use a defective design or a faulty manufacturing process in creating bed rails that did not keep elderly nursing home residents safe from falls and other injuries as intended?

Actos Side Effects Continue To Draw Injured People To Lawsuits

Long-term use of the diabetes drug Actos has been linked to an increased risk of bladder cancer. Takeda Pharmaceuticals allegedly knew of the potential for serious and even fatal side effects from the diabetes medication but covered them up or otherwise failed to warn patients and doctors of the risks.

Over 100 lawsuits have been filed against the drug manufacturer related to the defective diabetes drug. And that number continues to grow. Another individual recently filed suit after contracting bladder cancer in 2006. He began taking Actos in 2004.

I called Knapp and Roberts to discuss a possible case. Instead of a caring and empathetic listener, I was greeted with impatience and hostility. I shared very personal details about an issue that was very important to me, only to have it argued against and belittled. If you have a personal injury case, this is the last place you should look. I hope someone puts them out of business.
