Washington State: What is pain and suffering? How is calculated?

If you have been injured because of someone else’s carelessness, you can usually seek compensation from the at-fault party’s insurance company, by filing what’s called a third-party claim.

After establishing that the defendant is the one responsible for your injuries (liable), you will also need to present evidence of all your losses associated with the incident. The insurance company should compensate you for your medical expenses as well as any lost wages you incur. In addition, the insurance company should provide you with some compensation for your general “pain and suffering.” Here is a description of exactly what that means: LINK

Washington Divorce: How long will it take for my divorce to be final?

Washington has a mandatory 90-day waiting period for divorces. This means you have to wait at least 90 days until you can finalize your divorce from the date of filing. In King County, when you file for divorce, you are assigned a case schedule and a trial judge. Your trial date will be about a year from the date of filing. You can settle your divorce at any time before your trial date (you and your spouse agree on a division of the community assets and liabilities, spousal support (if any), and child support and a parenting plan for any minor children of the marriage. The trial date can also be pushed back. So, the short answer is you can finalize your divorce as early as 90 days after filing or it can take a few years. It all depends on how much you and your spouse are able to agree on resolution.

The United States is one state closer to a popular vote for presidential elections.

Our country is now closer than ever to reforming the electoral college in favor of a “one person, one vote” system for presidential elections. New York joined 10 other states and the District of Columbia in joining an interstate compact that would require the state’s electors to cast ballots in favor of the winner of the popular vote.

This is an interesting case for a couple of reasons: 1) It does not appear that the Defendants have homeowners insurance as their insurance company would typically pay for these types of cases; 2) If they did not have insurance, the first question I would ask is ‘how much money/ assets do they have as they will likely file bankruptcy if the answer is little to none. #dogbitecase   #personalinjurylawyerkirkland
