Owners who have been saddled with the previous homeowners' debt have been thrown a lifeline by a Pretoria High Court ruling which declared a section of the Local Government Municipal Systems Act constitutionally invalid

Judge Dawie Fourie ruled on Tuesday that it is unlawful for municipalities to hold property owners liable for the payment of debts of previous owners or tenants, reports Timeslive.

This means that a number of households across metropolitans will breathe a sigh of relief as they can no longer be forced by their municipalities to pay off debt incurred by previous owners as it is now unlawful for the municipalities to cut off services to those affected.

Despite the good news for home and business owners, municipalities have warned that this ruling could collapse those areas that are already struggling with getting money back from delinquent payers.
