"Ask Grant" Q: What happens if I refuse to take a sobriety test?
A: There are several different types of sobriety tests. They include motor and mental functions as well as breath and/or blood tests. Refusing a chemical test could result in increased criminal penalties. However, as a general rule, refusing to answer questions and performing tests will almost certainly increase the chances of your case getting dismissed. Unless you are 100% certain that you have not broken any laws, it is better to keep your mouth shut, refuse all test -- and call your attorney at 505.235.6777
