Mbigi v. Wells Fargo. In 2016, SMITH LAW, LLC represented a homeowner in the Georgia Court of Appeals, and obtained a reversal of the trial court's order dismissing the homeowner's claim for wrongful foreclosure and for violation of Georgia's RICO statute. Specifically, the Georgia Court of Appeals held that the trial court erred in finding that a mortgagor’s claim that the mortgagee breached its duty in failing to provide proper notice of the foreclosure sale showed no basis for a wrongful foreclosure claim because an allegation that a lender failed to provide notice of foreclosure as required by O.C.G.A. § 44-14-162.2 supported a wrongful foreclosure claim under Georgia law. The Georgia Court of Appeals further held that the trial court erred in dismissing the mortgagor’s RICO claim because the complaint alleged that the mortgagor was injured by at least two predicate acts (theft by deception and residential mortgage fraud) which could constitute a pattern of racketeering activity.

In 2015, SMITH LAW, LLC represented an inmate who was the victim of excessive force. An internal investigation confirmed that the deputy's conduct violated county policy. That case resolved successfully.
