When a loved one dies and leaves a valid will they likely name an executor; someone to protect the deceased person’s property until all debts and taxes are paid and transfer the remaining assets to heirs.  Missouri law does not require an executor to be a legal expert, but they must use a high degree of honesty known as “fiduciary duty” which means to act in good faith and honesty on behalf of another person.

A Will is a legal paper that states who receives your property when you die but it is important to note that a Will does not avoid the necessity of probate and must be “probated” to have legal effect.  Many people prefer to pass some or all of their assets directly to their heirs without going through the probate process.  Although this is not always possible, there are some steps that Missouri residents can take to avoid probate.

Traffic ticket fines and court fees vary by violation and county court within the state of Missouri.  Speeding tickets written in the state of Missouri by the Missouri State Highway Patrol are considered state law violations while municipal police agencies write tickets that can be prosecuted in State or Municipal Court. The Missouri State Highway Patrol provides that in 2014, there were 106,932 speeding citations issued.

For those individuals who are behind in making their mortgage payments, or who expect to become behind in those payments, there are several options that you can discuss with a skilled foreclosure attorney.  One such option is called a Deed in Lieu of Foreclosure, which allows the homeowner to offer a deed to the mortgage holder or lender.  Upon receipt of the deed, the mortgage company cancels the mortgage agreement.

When a homeowner becomes late with their monthly mortgage payments, the lender or mortgage holder may contact them directly indicating that they intend to foreclose.  When a homeowner receives such a communication, it is important to contact a skilled foreclosure attorney, in order to discuss all of the options and possible solutions available to try and avoid foreclosure.

St Louis foreclosure activity in January 2016 was at the rate of 1 in every 1,533 households.  This foreclosure activity rate is down almost 16 percent from December and down over 25 percent (25.79%) from a year ago, according to the latest data from RealtyTrac.  Even with this recent downturn, there are still many foreclosure cases being filed in the state of Missouri.

Undue influence is the misuse of one’s role and power to exploit the trust, dependence, and fear of another to deceptively gain control over that person’s decision in a particular matter. Missouri case law has articulated three (3) elements which usually must be present in order to find that undue influence has occurred: (1) a fiduciary or confidential relationship between the influencer and testator or settlor; (2) a substantial benefit to the influencer; and (3) facts from which undue influence may be inferred.

Unfortunately, estate litigation is an inevitable part of many estates. When a decedent dies, the estate must usually pass through a formal legal process known as probate. The executor of the estate under the terms of a will must request that the court open a probate estate at which time the assets are accounted for and valued.  Any individual with a claim against the estate is given the opportunity to file a claim with the court.

Lt. Col. Kenneth Carp, a St. Louis Veterans Affairs attorney, is forming a Facebook group called “Vietnam Vets – Agent Orange” to include veterans like Bill Casto, who need a support group to share their experiences.

Mr. Carp feels that the government has turned its back on the people it depended on most in the worst of times. The VA will find every loophole possible to avoid giving out benefits to veterans.

The group started by Lt. Col. Carp is an open forum which encourages Vietnam veterans to come together and support each other. Mr. Carp believes that the Vietnam Vets have been the “Ignored Vets,” and his group is taking the first step in rectifying that.
