In our latest article we review the amendments approved by the European Parliament and the Council of the European Union on the 30th of May 2018 for Directive 2010/31/EU on the energy performance of buildings (EPDB) and Directive 2012/27/EU on energy efficiency.

Personally, I think that this is a huge step in the right direction with a visible move toward continual assessment of in-use energy performance and a holistic approach to energy efficiency that includes optimised health, indoor air quality and comfort levels!

All will be revealed when the revised Energy Performance of Buildings (Certificates and Inspections) (England and Wales) Regulations are published, but my hope for 2019 and beyond is that this will lead to significantly better compliance with the Regulations and business embracing indoor environmental quality and energy efficiency as key differentiators!

The EA's December ESOS Newsletter has just arrived! The attached chart provides a breakdown of the audits by outcome and comparison with previous audit results.

Areas where non-compliance issues were identified included ESOS Energy Audits not meeting the minimum criteria and the sampling approach for audits not being representative of the Significant Energy Consumption.

Both, but more specifically the latter did not come as a shock to us as the EA's Complying with ESOS guide states the following in 5.7 You don’t have to visit every site where large undertakings hold more than one site.
Organisations with multiple sites or assets that are identical or very similar can take a proportionate approach and apply the energy saving opportunities identified in their site visits to their wider portfolio.
The lead assessor and participant organisation should determine a suitable site visit sampling approach to reflect the energy consumption patterns of their assets and activities.
This is not prescribed in legislation and as such it is up to your organisation and lead assessor to agree this.

The sampling approach is therefore open to interpretation, and if the client is focussed on price alone could potentially lead to non-compliance and a lot of frustration!

A good question to ask at the outset is how many visits/audits have been allowed for in the quote and if that approach would satisfy a compliance audit by the regulators.

The UK Governments Streamlined Energy and Carbon Reporting (SECR) framework comes into force from April 2019. SECR replaces the CRC Energy Efficiency Scheme (CRCEES) from the end of the 2018/19 compliance year. Increased Climate Change Levy (CCL) charges will recoup lost CRCEES revenue for the UK Gov. From 1 April 2019 the main CCL rates for electricity will increase from 0.583p/kWh to 0.847p/kWh and natural gas will increase from 0.203p/kWh to 0.339p/kWh. The final guidance for reporting should be published in Jan 2019. Reporting for qualifying companies will be included in their annual accounts. We will be posting a more detailed summary covering qualification criteria, dates etc soon.
