A set of laws called exemptions offer some protection to vehicles in bankruptcy. Depending on the value of the vehicle and the amount owed against it, you may be able to protect or “’exempt” its value from liquidation. Because exemption laws are complex, it is important to thoroughly discuss the value of all your assets, including your vehicle, with an attorney before filing bankruptcy. During your consultation with a Cascade Bankruptcy attorney, we will ask all the relevant questions to determine whether your vehicle will be protected.

Criminals are always on the lookout for new ways of ripping people off. They may acquire your personal financial information by stealing your mail or going through your trash for documents you have not shredded. More “advanced” crooks may use ATM skimming devices at gas pumps or other machines, and others may call or email to try to get you to disclose your personal information. Being aware of these schemes can help you to protect valuable information that could later be used to hurt you.
What do you do if you have discovered that someone has stolen your identity and racked up a bunch of debt in your name while you are filing bankruptcy?
Most people don’t expect to be a victim of identity theft, but the real question begs to be answered. What do you do now?

Most homeowners contemplating bankruptcy are concerned with whether they will be able to keep their homes. Depending on the value of your home and how much you owe against it, you may be able to protect the equity, keep the house and discharge other debts.
If this issue concerns you, it is crucial that you seek advice from a competent attorney to determine whether you can protect your home in bankruptcy.

Most debts are eliminated in bankruptcy. In some circumstances, you may wish to continue to pay on a debt in order to keep property, such as a vehicle. A “reaffirmation agreement” is an agreement entered into during a bankruptcy case that revives such a debt. A reaffirmation agreement is voluntary and you are not required to sign one. However, some creditors require that you either reaffirm your debt or surrender the vehicle.
Should I reaffirm a debt?
The best question to ask yourself in determining whether to reaffirm a vehicle loan is: ”would I buy my vehicle today for the amount I owe?” It is typical for the value of a vehicle to fall faster than the payoff balance, leaving many vehicles underwater by the time a bankruptcy case is filed. If you owe your creditor far more than the vehicle is worth and you have the ability to find alternate transportation, it is probably not in your best interest to sign a reaffirmation agreement. On the other hand, if your lender agrees to lower the balance or interest rate and you need the vehicle, you may decide to reaffirm the loan.

We understand that filing bankruptcy can be extremely difficult and we want you to feel good about working with us. Here is one of our testimonials to help give you peace of mind when you call us..
“Brian Turner was my attorney and he was helpful and friendly and was able to answer all my questions that I had. If I needed to get in touch with him, I was able to get a return call by the end of the day if not if not sooner. There were a couple of situations that arose, and he was able to get on top of them and take care of them fast. It was easy to get appointments and was helpful getting the paperwork squared away with me. They were able to work with me on making payments where most do not or would not file until they were paid in full first and are very reasonably priced compared to others I inquired about. If you want fast and professional attorney for your bankruptcy I would recommend Cascade to any one who is looking. Thank you Brian and all the staff you have working with and for you.” – J.M.
