Can I be fired while on workers compensation?

Some employees fear this when considering whether to file for benefits or not, preferring to use healthcare to cover doctor visits and minimize on their expenses. Unfortunately for these workers focused on not rocking the boat, most doctors will reach a stage where they won't operate further until workers comp is filed and used as insurance to cover their work.

This question really depends on what type of employee you are. See, it IS against the law to fire someone specifically because they filed for workers comp, as that counts as discrimination, and will usually result in a prompt lawsuit and investigation.

That being said, at will employees without contracts can be fired whenever and for any reason, creating a grey area where employers can hide their motives. Realistically speaking however, the solution isn't quite that simple.
