It is completely understandable that a person might think that a divorce can be easily resolved by downloading a few forms, filling them out and filing them with the court. The divorce process can be expensive, so some folks will try to cut those costs by doing it themselves.

The Tennessee Supreme Court has just adopted forms for those who want an uncontested divorce, but have minor children. These new forms and instructions were released in an effort by the court to simplify divorce proceedings for those who have both agreed that the marriage is over and they are looking for a simple divorce solution.

The last few years have been tough for the economy, and tough on folks who were out of work, or whose jobs didn’t pay them enough to make ends meet. So when I hear about people finding work that really suits them, or will give them a little more breathing room, I’m genuinely happy for them.

Divorce brings a lot of changes, but most folks I help can anticipate the majority of them. What really throws people off, however, is when things need to change after the divorce is finalized and the parenting plan is set. When there is a “material change in your circumstances,” and that change is going to affect your children (either through child support or through your available time to be with them), you must go through the court system to modify your parenting plan.

Raising a child is hard enough to do under the most ideal circumstances. When you and your spouse decide to divorce, however, it becomes even trickier. Maybe you trust your former wife or husband, maybe you don’t – all you know is that you can’t be there for every conversation and to guide your child when he or she makes decisions.

If you had the inclination, you could read through the entire Tennessee Code to learn the laws regarding divorce and custody. But if you’re going through a divorce, the chances are you have enough on your plate already.

In a perfect world, two people who don’t want to be together anymore will divide their things, shake hands and ride off into their respective sunsets with no hard feelings. Of course, this is not a perfect world, and people rarely decide to split in such an amicable way. Because tensions can run high during a divorce, Tennessee requires that most couples undergo mediation to help smooth out any wrinkles, and to (ideally) help both sides obtain what is fair.

If you are a grandparent who is being denied access to your grandchildren, take heart: there are options available to you under the law. I just want you to be prepared before you start the legal process, because while the Tennessee courts do recognize grandparents’ rights when it comes to access, those rights are not guaranteed.

Even under the best of circumstances, child support can be an… issue. Of course you want what’s best for your child, and of course you don’t begrudge your child anything – but does your ex-spouse really need all that money for school supplies and doctors’ co-pays?
