"The personal attacks on the distinguished district judge and our colleagues were out of all bounds of civic and persuasive discourse—particularly when they came from the parties. It does no credit to the arguments of the parties to impugn the motives or the competence of the members of this court; ad hominem attacks are not a substitute for effective advocacy. Such personal attacks treat the court as though it were merely a political forum in which bargaining, compromise, and even intimidation are acceptable principles. The courts of law must be more than that, or we are not governed by law at all."

Students from across the nation submitted powerful and insightful videos.
We are pleased to announce that Fátima Casas, an undergraduate student at the University of California at Berkeley, has been selected as the winner of the inaugural Dolan Law Firm Justice Empowerment Scholarship. We awarded Casas a $2,500 scholarship.

The purpose of the Justice Empowerment Scholarship is to encourage young persons to advance the cause of social justice. Scholarship applicants were required to produce and post on YouTube a short video on the topic of justice. Twenty-four students from across the nations submitted videos.

A first year student at UC Berkeley,Casas is studying political theory and ethnic studies in pursuit of a future career in the law. In her powerful video, Casas returns to her hometown of San Bernardino, California, to discuss issues of terrorism and gun violence, police brutality, lack of educational opportunity, full equality for the LGBT community, and the refugee and immigration crisis. “Growing up in my city has opened my eyes to the systematic injustice that suffocates people every day,” Casas stated. “Justice is shining a light on the dark forces of oppression and fighting cultural stereotypes and prejudice that bring us down. The social justice warrior in me aspires to have the courage to change the institutions of power that dehumanize and exploit us.”

Slip-and-fall injuries occur frequently in supermarkets, groceries and convenience stores. Many times boxes of new items are left in the aisles for employees to open and stock the shelves. In the meantime, these boxes create a tripping hazard for shoppers. It is also common for customers to spill containers of milk, soda, wine and other liquids in the aisles. If another customer immediately falls on the wet floor following a spill, usually there would be no basis for bringing a premises liability lawsuit against the supermarket, as the manager most likely would not have notice of the dangerous condition or an opportunity to correct it. On the other hand, if a store employee learned of the hazard and did not immediately clean it up or provide a warning until someone could promptly come and clean it, there would be a sound basis to bring a legal claim.

Legal responsibility, called “liability,” for a car accident often depends upon proof that another driver was at fault. The other driver, however, does not have to intentionally cause the crash. Proving the other driver operated the vehicle in an unsafe and unreasonable manner under the circumstances, known as negligence, is sufficient evidence to demonstrate liability.
California law allows injured drivers and passengers, and the families of the loved ones who have died or were injured in car accidents, to file a lawsuit against those responsible for the accident. The Dolan Law Firm represents clients injured (and families whose loved ones died) in all types of serious car accidents, including crashes involving speeding, distracted, or drunk drivers. We have the experience and the resources to handle any type of car accident lawsuit.

California Civil Code § 1714(a) states, “Everyone is responsible, not only for the result of his or her willful acts, but also for an injury occasioned to another by his or her want of ordinary care or skill in the management of his or her property or person, except so far as the latter has, willfully or by want of ordinary care, brought the injury upon himself or herself.”
What is a Slip and Fall Lawsuit?

Answer: A Slip and Fall lawsuit is a civil action against a property owner seeking compensation for the injuries a person suffered from slipping or tripping and falling due to an unsafe and dangerous condition on the property. Slip and fall lawsuits fall within a broader category of cases known as premises liability lawsuits.
