We need to put weight to the "harm" test in copyright where the copy's harm on the market for the original work is considered.  In many cases such as lyric sites, let's play video, and more, the copy, fair use on other tests as well, actually increases the market for the original work.

This hints at the constant struggle between project based and time based value. I think this is why programming is seen both as consulting and science/art. I think the truth is it's a little of both.

Upon even further reflection, I believe that the US Supreme Court rulling that a tomato is a vegetable for tax purposes, ignoring scientific fact of its fruit DNA, points out exactly what is wrong with the US patent system as it relates to software.

If I had to reconcile all political, religious, and moral beliefs with a creator before I could enjoy their work I'd have a very dull art life.  As Dave Chappelle once said "he gave us Thriller.  Thriller".  I could also say that good art creates discussion, and that the life of the creator can be part of that.  I think this logic however doesn't carry over when we talk of a product, such as a sandwich or say a badly named lipstick, but at some point you do look the other way (I've never seen a mass boycott of smart phones and high end electronics over safe labor violations at Foxconn). 

For the record I do not eat at Chick-Fil-A because I do not believe the word "Deluxe" was created to mean "lettuce and a slice of tomato".  Not supporting anti-gay bigotry is just the bonus.
