In North Carolina, there are four main reasons why a landlord may evict a tenant: 1) Non payment of rent; 2) tenant holding over after the term of the lease; 3) the tenant breaches the term of the lease; 4) any criminal activity (ex. drug trafficking) on the premise. Even if the eviction is justified under the following reasons, the landlord must follow the legal process in order to evict. If the landlord uses "self-help" to evict a tenant, the tenant may claim the eviction was "illegal", which therefore, will have a valid defense in court.

In North Carolina, if you win a judgment for money owed in Small Claims Court, the opposing party has 10 calendar days from the day of the judgment to either pay the prevailing party or appeal the case. If you decide to pay the prevailing the party, you can go directly to the clerk's office in the court house; mail in a check to the clerk's office; or pay the opposing party directly. Just make sure your payment is docketed with the clerk's office if you decide to pay the opposing party directly.

Debt Collectors may often use "scare" techniques, for example, sending your a complaint, in order to collect their debts. More often than not, they would be willing to settle without bring the collection proceeding to trial. All you need to do is talk to them to negotiate some form of payment plan and more often than not, they will be willing to work with you.

For Divorces, North Carolina is a "No Fault" Jurisdiction. This means the spouses do not have to prove the other spouse was "at fault" in order to get an absolute divorce. All that is required is the couple live separate and apart for the duration of one year. Once the year deadline has passed, the couple can file for an absolute divorce. Please give our office a call if you need any help: 336 355- 7023.

DWLR or "Driving While License Revoked" in North Carolina is a Class 3 Misdemeanor. However, if your license was revoked as a result of a DWI or "impaired driving," and you get charged with a DWLR, the charge is elevated to a Class 1 Misdemeanor.
