My latest paper, with Jeanne Fromer, considers the different ways IP regimes view infringement, and suggests a hybrid approach that focuses both on the similarity of the works and the market effect. http://papers.ssrn.com/sol3/papers.cfm?abstract_id=2272235

Flora and Fauna (BACK TO THUMBNAILS). Here Comes the Sun Oil on canvas 22"H x 28"W. Part of the Exuberant Flowers series. Painting flowers gives me a great excuse to fill my studio with their beauty. Bright, cheerful sunflowers are one of my favorites – they never fail to make me smile.

I personally don't see the negatives - copyright can be for a longer period whereas design patents only protect for 15 years.  With all the subjective discussion on how to define infringement of a design I would think that is best suited for a copyright discussion.
